Terms & Conditions of Sale
2.1 The description and price of the goods you order will be as shown on our website at the time you place your order. 2.2 We endeavour to stock all items featured on our website. If on receipt of your order the goods are not in stock, we will inform you as soon as possible with an estimated delivery date. 2.3 Out of stock items may, at our discretion, be back ordered. 2.4 Every effort is made to ensure that prices shown on our website are accurate at the time you place your order. If an error is found, we will inform you as soon as possible and offer you the option of reconfirming your order at the correct price, or cancelling your order. 2.5 In addition to the price of the goods, and VAT if residing in the UK or the EU, you will be required to pay a delivery charge for the goods, except where agreed, or where you collect your order from our premises.
3.1 Payment for your goods can be made either by Credit/Debit Card, Cash, Cheque, or direct Money/Cheque Transfer to our bank account. Payment shall be due before delivery/collection of your order. There will be no delivery until cleared funds are received. 3.2 Payments shall be made by you without any deduction whether by way of set-off, counterclaim, discount, abatement or otherwise unless you have a valid court order requiring an amount equal to such deduction to be paid by us to you. No credit facility is available.
4.1 The goods you order will be delivered to the address you give when you place your order. 4.2 Orders placed before 3:00 pm on a working week day will be dispatched for next day delivery and will be delivered as per the requested delivery option, provided all items are in stock. (Working week days are any day other than weekends [Saturday & Sunday] and bank or public holidays.) 4.3 If delivery cannot be made to your address for reasons under our control, we will inform you as soon as possible. 4.4 If you deliberately or otherwise fail to take delivery of the goods, Racebolt will accept no liability for any loss of profit or otherwise. 4.5 If you fail to take delivery because you have cancelled your contract under the Distance Selling Regulations, Racebolt shall refund or re-credit you within 30 days of notification for any sum that has been paid by you, less any expenses incurred for failed delivery. 4.6 Every effort will be made to deliver the goods as soon as possible after your order has been accepted. However, we will not be liable for any loss or damage suffered by you through reasonable or unavoidable delay in delivery. We will inform you, if we are aware, of any expected delays regarding delivery of your order. 4.7 Upon receipt of your order you will be asked to sign for the goods received in good condition. If you are unable to check the contents of the package before signing you must indicate this by signing for the parcel as unchecked. Failure to do so may affect any claims you make thereafter.
5.1 The goods are at your sole risk from the moment they leave our premises. 5.2 Ownership of the goods shall not pass to you until we have received in full all sums due to us in respect of the goods, and all other sums which are or which become due to us from you on any account. 5.3 We shall be entitled to recover payment for the goods notwithstanding that ownership of any of the goods has not passed from us.
6.1 You have the right to cancel the contract at any time before the products have left our premises. 6.2 You must contact us immediately if you suspect a mistake was made during the order process, or if an item is damaged. 6.3 If you exercise your right to return an incorrectly dispatched or damaged item after the goods have been delivered to you, you will be responsible for returning the goods to us at your own cost. The goods must be returned to the address found in our contact us section. You must take reasonable care to ensure the goods are not damaged in the meantime or in transit. For your piece of mind, we recommend using recorded or special delivery where a signature is required. If the goods sent to you are found to be damaged or sent in error, replacement items will be duly dispatched and the cost of delivery will be waived. 6.4 Once you have notified us that you are canceling the contract (subject to term 6.1) we will refund or provide a credit note within 30 days of notification for any sum that has been paid by you for the goods. 6.5 Subject to term 6.1, if you do not return goods as required, we may charge you a sum not exceeding the direct costs of recovering the goods. 6.6 If you return an item that was incorrectly dispatched to you by Racebolt without prior notification to us, you may incur an administrative charge while we investigate the returned items. 6.7 Any items returned to us notwithstanding term 6.1 shall be destroyed, for which you may incur the full cost.
7.1 All goods manufactured by Racebolt and supplied to you are guaranteed free from manufacturing defects. 7.2 This warranty does not apply to any defect in the goods arising from wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by us, failure to follow any instructions we provide either verbally or written, or any alteration or repair carried out without our approval or against our recommendations. 7.3 If the goods supplied to you are damaged on delivery, you must notify us within 7 days to arrange return delivery of the damaged item. We will dispatch replacement items, providing upon receipt of the damaged item, it is found to be damaged and we are satisfied that term 7.2 has been adhered to. 7.4 If the goods supplied to you develop a defect while under warranty or you have any other complaint about the goods, you should notify us in writing via email as soon as possible, but in any event within 7 days from the date you discovered or ought to have discovered the damage, defect or complaint. 7.5 You must keep all documentation pertaining to your order for us to process your claim.
8.1 Racebolt reserves the right to cancel, withdraw, alter, amend, reduce, increase, set in place constraints (for example, but not limited to, time and discount limits), and append any current and future discounts, offers, abatements and discounts at any time, without prior notice.
9.1 Racebolt ´ total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of this agreement shall be limited to the price paid for the goods. 9.2 Racebolt shall not be liable to you for any indirect or consequential loss or damage (whether for loss of profit, loss of business, depletion of goodwill or otherwise), costs, expenses or other claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with this agreement.
10.1 We will take all reasonable precautions to keep the details of your order and payment secure but unless we are negligent, we will not be liable for unauthorised access to information supplied by you. 10.2 These terms of sale and the supply of the goods will be subject to English law and the English courts will have jurisdiction in respect of any dispute arising from the contract.
11.1 You agree to be legally bound by these terms and conditions once a contract is in place between you and Racebolt (see terms 1.1-1.5). We recommend you print these Terms & Conditions for your reference.
Shipping and Delivery
- All orders are sent from the UK using the services of the Royal Mail and Air Mail
- All orders sent using 1st standard delivery will not be insured and Racebolt will not be held responsible if the order is lost in postage, if this delivery method is selected.
- Overseas orders are charged at standard prices per KG (see postage rates) no matter where or the value of the order.
- All Items are manufactured by us, so it can take up to seven working days for orders to be dispatched if the item is not in stock.
- Orders to the UK should be delivered next working day of dispatch. Orders sent outside the UK but inside the European Union should be delivered within 5/10 working days of dispatch. Orders outside the EU should be delivered within 7/14 working days of dispatch.
- If uk orders have not been received within 14 days of dispatch or overseas within 28 days of dispatch, please contact us and we will (where possible) re-send the order.
